NARINDAR SINGH Vs. UNION OF INDIA (UOI)

JUDGEMENT

(1.) THE applicant, who is an Indian Revenue Service (IRS) Officer Income Tax (IT) of 1972 batch, is aggrieved by the fact that he has been overlooked for selection to the post of Member, Central Board of Direct Taxes (CBDT) and his juniors have been promoted to the aforesaid post.

(2.) THIS O.A. was being heard along with O.As. number 1927/2008, 2808/2008, 1731/2008 and 234/2009, in all of which identical issue was being considered. The criteria evolved by the Selection Committee for selection to the post of Member, CBDT is under challenge in the O.As. adverted to above. Later, in the instant O.A., submission was made on behalf of the applicant, Shri Narinder Singh, that he would not challenge the criteria for selection evolved by the Selection Committee but would challenge the application of the criteria in his case by that committee. This O.A. has, therefore, been de -segregated from the other O.As. mentioned above and considered only with regard to the applicant's challenge to the application of the criteria for selection in his case.

WHILE the O.As. mentioned above were being heard, an M.A. number 158/2008 was filed in O.A. number 1797/2008 for production by the respondents of the record in relation to selection process and disclose the criteria adopted by the Selection Committee. The respondents were directed to make available copies of the ACRs of the applicant considered by the Selection Committee as also the guidelines for the selection of Chairman and Members of the CBDT and CBEC issued in June, 2006 and amended on 13.7.2006 with the approval of the Prime Minister.
