C. MANOHARAN Vs. UNION OF INDIA AND ORS.

JUDGEMENT

(1.) THE applicant in this case seeks declaration that he is entitled to promotion as Technician Grade -III with effect from 7.7.2009 or in the alternative a declaration that he is entitled to have his seniority fixed in terms of paragraph 224(1)(iii) of Indian Railway Establishment Manual and to publish the seniority list accordingly.

(3.) IN the rejoinder filed by the applicant he contended that the applicant was not accommodated in a vacancy which was available at Trivandrum despite the fact that the applicant is an SC employee who had preference over others.
