(1.) The writ petitioner who is stated to be the wife of the deceased employee, who served in the office of the District Statistical Officer, Tura, is before this Court, praying for the release of pension and other terminal benefits of her deceased husband, who had retired on 30/11/2006.
(2.) Mr. S.K. Hassan, learned counsel for the petitioner submits that due to the long illness of the deceased employee, the writ petitioner was not in a position to follow up the case effectively, and though representation has been filed including a legal notice, as no reply was forthcoming, she has been compelled to come before this Court, by way of this writ petition. It is also fairly submitted by Mr. S.K. Hassan, learned counsel that the respondent No. 2, had also taken up the matter, and had issued directions, which are contained in Annexure – 11, annexed to the writ petition.
(3.) Ms. S. Bhattacharjee, learned GA for the State respondents has submitted that, the reason for the delay in the computation and settlement of the service dues of the petitioner, was due to the non-receipt of the required documents to ascertain her eligibility and the pensionary benefits that had accrued to the deceased employee. She submits that the non-receipt of the documents, which have been detailed in Para – 24 of the affidavit, has resulted in the non-disposal of the case of the petitioner by the respondents.
