These are two petitions where the though they were qualified in all respects they petitioners have a common grievance that all were not even called for interview either for promotion or for direct appointment to the post of Deputy Zonal Manager. Hence we are dis posing them of by this common judgment.
(2.) The undisputed facts are that the petitioner in Writ Petition No.3820 of 1986, namely D.M. Rane was appointed as a Junior Grader on 1-8-1974 and along with others he was promoted as Senior Grader by the order of Dec. 18, 1974. However, it appears that the order of promotion as a Senior Grader, though received by all others on Dec. 18, 1974, was received by the petitioner on Dec. 28, 1974 and it is on that account that his seniority in the provisional seniority list of Senior Graders, according to him, was shown at serial No. 80, because in the meanwhile those who had received their promotional orders earlier had joined as Senior Graders. He, there fore, contends that his seniority as senior Grader is at serial No. 69 and not at 80. He had made representations in that behalf but they were not replied to. Thereafter he was promoted as Sub-Zonal Manager with effect from Nov. 15, 1979. Even in the seniority list of Sub-Zonal Managers he was shown at serial No. 61 instead of at 53 because of his erroneous seniority shown in the seniority list of Senior Graders. Since this will have not much of a bearing on what follows, we need not be detained on this point.

In Writ Petition No.5896 of 1987, petitioner Chandrakant Ghamaji Gunjal had also similarly joined the services of the Maharashtra State Co-operative Marketing Federation Limited as a Junior Clerk on Oct. 30, 1972 and he was promoted as Senior Grader on Dec. 18, 1974. He was there after promoted as Sub- Zonal Manager on Nov. 13, 1979 and his seniority was correctly shown at Serial No. 55 in the seniority list of Sub- Zonal Managers.
