AJIT SINGH Vs. MARATHAWADA UNIVERSITY

JUDGEMENT

(1.) THIS petition is filed by the student studying in second Year Engineering Degree Course in a college of an institution affiliated to Marathwada University.

(2.) THE petitioner had successfully completed his First Year Engineering degree Course and had taken admission in Second Year Engineering degree Course. The petitioner had appeared for the examination held in October-November, 1987 by the Marathwada University, but his performance was cancelled by the University by an order dated 8-2-1988.

(3.) PRIOR to cancellation of performance in the examination, the petitioner was served with show cause notice on January 19, 1988. The allegation against the petitioner was that the wordings of answers of questions Nos. 1, 2 and 5 are exactly identical with that of other answers of the 14 candidates who simultaneously appeared for the said examination. Therefore the authorities suspected that the petitioner might have written answers from the material which was useful for copying. On these allegations, the petitioner was asked to show cause by the notice dated 19th January, 1988.
