JUDGEMENT

(1.) HEARD learned Counsel for the parties.

(2.) THE rejection of compensation for death of Suryakant Krishnaji Athalye, a Mechanical Engineer, aged about 42 years, in motor accident on October 29, 1984, is subject to challenge in the First Appeal.

(3.) P.W.4 - Prabhakar Bhagirath Dusane has beetle (pan) shop, says that the goods truck was in a high speed, when Suryakant entered the main road took a turn his moped came under the front driver side of the wheel. He removed Suryakant to Civil Hospital. P.W.5 - Suresh Mansaram Dalal is a senior clerk in R.T.O. established the driving licence of Suryakant (deceased) valid upto 1.2.1987.
