JUDGEMENT

(1.) Rule. Rule is made returnable forthwith. Heard finally with consent of the parties.

(2.) The plaintiffs feeling aggrieved by the order passed by the Civil Judge (Jr. Dn.), Warora on an application under Order 1, Rule 10 of Civil Procedure Code has preferred this writ petition.

(3.) The facts giving rise to the petition are as follows :
