JUDGEMENT

(1.) RULE. Rule is made returnable forthwith.

(2.) THE husband of the petitioner was working as Multipurpose Health Worker in the Health Department and he died on 8. 7. 1993 while in service. The petitioner therefore made an application for appointment on compassionate ground. The only reason for rejecting the claim of the petitioner is that the appeal was pending in the high Court against the petitioner for offence under section 302 of the Indian Penal code, Mr. Nagargoje, learned Counsel for the petitioner submits that the appeal has been dismissed and the acquittal is confirmed, that the State has not approached the Supreme Court and therefore, there is no bar to consider the claim of the petitioner for appointment on compassionate ground.

IT is, however, to be mentioned that under the Government Resolution dated 7th June, 1997, the appointment on compassionate ground has been centralised and all the applications are required to register their names with the Collector of the concerned district. We, therefore, direct the respondents to send the name of the petitioner to be included in the common register of the persons seeking appointment on compassionate ground maintained by the Collector, Aurangabad, within a period of four weeks from the date of receipt of writ of this Court. Rule is accordingly made absolute. There shall be no order as to costs.
