JUDGEMENT

(1.) The petitioner, who passed H.S.C. examination, took a correspondence course for diploma in education through the Institute of Rural Development and Multipurpose Technical Training Centre at Shirur, District Pune and passed D.Ed. course and was granted certificate from the said institute.

(2.) The petitioner enrolled herself with the Employment Exchange for teacher's job in primary school. Thereafter she applied for the post of primary teacher in Zilla Parishad, Nasik. She was called for interview. At the time of interview, on verification of her certification, she was told that the correspondence courses were not recognised for the purpose of appointment to the post of teacher in the primary school. The petitioner has thereafter applied for teacher's job in primary school run by Municipal Corporation of Nasik. She has filed this writ petition on the apprehension that she will not be taken up for job in that school also on the ground of her qualification. The petitioner, therefore, seeks a declaration that the petitioner and others holding D.Ed. certificate through correspondence course are equivalent to the candidates having D.Ed. certificates from the Technical Board.

We have heard the learned counsel for the petitioner, who submits that if the candidates holding D.Ed. certificates through correspondence course are not appointed as teacher in the primary school, it will cause great hardship to them. He submits that those holding certificates through correspondence course should be declared as equivalent to those having D.Ed. certificate from Technical Board. We find it difficult to accept the above contention of the learned counsel for the petitioner. In order to get the job of teacher, the petitioner must fulfill the eligibility criteria and must hold the qualification required for that post. If the certificate through correspondence course is not recognised for the purpose of appointment to the post of a teacher in a primary school, we do not find how this court can declare the certificate through the correspondence course as equivalent to the certificate from the technical board. We do not, therefore, find any merit in this writ petition.
