(1.) BOTH these petitions filed by Railway employees challenging the decision of the Railways not to promote them, were heard for quite sometime.
(2.) AFTER agitating their grievance before the Central Administrative Tribunal where their pleas were rejected by the bench of the Central Administrative Tribunal, Mumbai Bench, the petitioners have approached this court by way of these petitions.
(3.) SHRI Gangal then contended that rule 219(f) provides that the Selection Board will examine the service record and confidential reports (if kept) of the staff eligible. All the members of the Selection Board should independently assess the candidates under different headings of personality, leadership etc.and record the marks awarded by them in the mark sheet given to them and the same should be signed and handed over to the Personnel Officer who should average the marks given by members of the Selection Board and be responsible to compile the results on the basis of marks given by the members of the Selection Board. This evaluation chart prepared by the Personnel Officer should thereafter be signed by all the members of the Selection Board., The members nominated on a selection board should be advised clearly that there should not be any cuttings and overwriting in the proceedings of the selection board and serious objection of any cuttings and overwriting will be taken. Shri Gangal therefore submits that the respondents be called upon to show marks assigned by individual members and in the absence of such record there is no compliance of rule 219(f) of the said rules and therefore the selection process ought to be held as vitiated.
