JUDGEMENT

(1.) The appellant has been convicted for the offences under Section 7 and 13(2) R/W 13 (1)(d) of the Prevention of Corruption Act 1988, and sentenced to suffer S. I., for 1 year and pay fine of Rs.1,500/- in default to suffer further S.I., for 3 months and to pay fine of Rs.2,000/- I/d further S. I., for 6 months.

(2.) The charge is for demanding and accepting bribe of Rs.1000/- towards passing bill for use of taxi of PW-1 for June 1994.

(3.) The PW-1 Martin Moris approached the Superintendent of Police CBI Nagpur, and submitted written complaint on 9-7-1994, and a raid was arranged. According to the prosecution, the accused had called the PW-1 with bill and bribe money in the Office, however, as he had left the office, at the suggestion of in charge of the raiding party, the complainant spoke to accused on phone by calling at his residential telephone, from a PCO booth, and on the say of the accused they moved to the house of the accused.
