JUDGEMENT

(1.) Heard petitioner in person as well as learned Counsel for respondent No.2.

Under the impugned judgment and order learned Labour Court has declared that the petitioner himself has resigned from service and in lieu of that had accepted an amount of Rs.70,000/-, obviously appears to have been received by way of compensation and with a view to have separation of relationship of master and servant.

(3.) I have no doubt that the learned labour Court after going through the evidence came to appropriate conclusion. It appears that the petitioner accepted the amount of Rs.70,000/- immediately on the next day i.e. on 15.3.2003. Now the petitioner in person argues that he accepted the said huge amount because he wanted to satisfy the need due to hunger. It is difficult to believe such type of statement or argument since one does not require Rs.70,000/- for satisfying the hunger. Therefore, the entire attempt of the petitioner appears to be to get more and more from the employer, which is wholly impermissible in law. There is no substance in the writ petition. The same is, therefore, dismissed.
