(1.) The appellants have assailed the finding of conviction and sentence recorded by the learned Additional Sessions Judge, Ahmednagar, dated 24th October 2007, in Sessions Case No. 179/2006. By the said order, accused no.1 Babaji is convicted of the offence punishable under Section 20(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (For short, "the NDPS Act") and sentenced to suffer rigorous imprisonment for five years and to pay a fine of Rs. 20,000/-, in default of payment of fine, to suffer further rigorous imprisonment for six months. Accused no.2 Santosh and accused no.3 Vijay are convicted of the offence punishable under Section 20(c) of the Act and each of them are sentenced to suffer rigorous imprisonment for ten years and to pay a fine of Rs. 1,00,000/-, each, in default of payment of fine, to suffer further rigorous imprisonment for one year each.

(3.) At the conclusion of the trial, the trial court convicted the appellants / accused and sentenced them as aforesaid. Being aggrieved thereby, the present appeal.
