JUDGEMENT

(1.) The petitioner who is a student of Post Graduate Diploma in Orthopaedics is seeking our writ of mandamus directing to grant him the first term of January 1996 so that it would facilitate him to appear for examination to be held in November, 1997.

(2.) After hearing Mr.Pradhan for the Petitioner and Mr.Ketkar for the University what is revealed for our adjudication is thus:

(3.) Having regard to these circumstances as enumerated, we direct Respondent No.4-Shivaji University to grant the petitioner the first term and permit him to appear for the examination which is to be held in November 1997, if he fulfills other conditions. Rule is made absolute in terms above.
