(1.) THE appellant aggrieved by the judgment and order dated 30th July 1990 passed by the Additional Sessions Judge, Pune, in Sessions case No.482 of 1989 convicting and sentencing him to undergo R.I. for 3 years and to pay a fine of Rs.3000/-, in default to suffer R.I. for 3 months, for an offence under section 304 Part II IPC, has come up in appeal before me. Along with the appellant were tried to co-accused Maruti Khengare, Manohar, Kashinath, Sakharam Govind and Chandrakant but they have been acquitted vide the impugned judgment.

(3.) THE FIR of the incident was lodged by Vithal on 15th May 1989 at 5.45 a.m. at Police station Paud. On its basis C.R. No.39 of 1989 was registered against the appellant and others.
