JUDGEMENT

(1.) None appears for the parties.

(2.) In view of our decision given today in Civil Reference No.1 of 1998, Asis Ubaldo Rodrigues v. Maria Asis Rodrigues, we hold that the reference made by the Family Court No.1, Pune was uncalled for and unnecessary. The decree dated 28th March, 1999, passed by the Principal Judge, Family Court No.2, Pune shall be treated as a final decree subject to appeal under section 19 of the Family Courts Act, 1984.

(3.) Reference is disposed of accordingly.
