JUDGEMENT

(1.) By this application filed under Sec. 115 of the Code of Civil Procedure the petitioner has impugned order dated 7th Dec., 1994 passed by the learned Additional District Judge, South Goa in Misc. Civil Appeal No. 147/03/A arising from the order dated 28th September. 1993 passed by the Court of the Civil Judge, Senior Division, Margao.

(3.) On 10-5-1985 the trial Court passed an order of ex-parte injunction in Special Civil Suit No. 110/85. The said order of injunction reads as under:-
