SHEIKH ORFAN SHEIKH MANYAR Vs. STATE OF MAHARASHTRA

JUDGEMENT

(1.) Present application is preferred by the applicant for quashing of the First Information Report in connection with Crime No.55/2019, registered under Sec. 306 of the Indian Penal Code and the consequent proceeding arising out of the same bearing R.C.C. No.326/2025.

(2.) The crime is registered on the basis of a report lodged by Vitthal Namdeo Payghan father of the deceased on an allegation that deceased was working for R.K. Ventures at Customer Service Centre, as a District Co-ordinator for Bank of India, Bank of Baroda and Kiosk Banking.

(3.) The nature of the work of the deceased is like a agent for allotment of customer service point. It is further alleged that the deceased was missing for some days. He was residing at Khamgaon on a rental basis and not returned home for 5 to 6 days and also was not at office. On 9/4/2019 the informant received a message from his cousin brother that deceased has committed suicide by hanging himself. The informant immediately rushed to the spot of incident. During inquest panchanama one chit was found in the pant pocket of the deceased wherein it was mentioned that the applicant and other co-accused are responsible for his death. On the basis of said report Police have registered the crime against the present applicant.
