JUDGEMENT

(1.) HEARD Mr. Manohar, learned counsel for petitioner, mrs. Khade, learned Asstt- Govt. Pleader for respondents 1 to 3 and Mr. Samarth, learned counsel for the respondent no. 4. Rule, made retunable forthwith by consent of the parties.

(2.) MR. Manohar, learned counsel for petitioner, states that petitioner is the widow of Narayan Gopalrao Chitnavis, who died on 6th August, 2002, due to fall of a tree in the Collectorate Compound. Mr. Narayan chitnavis was the practising Advocate and on the fateful day, i. e. on 6th august, 2002 at about 4-00 p. m. , after completing court work, he was going to Treasury Office for collecting stamps worth Rs. 3,000-00. It is submitted that when the petitioner's husband was in the Compound of collectorate, Nagpur, a big old tree fell on his person causing serious injuries and at the later point of time, the husband of the petitioner succumbed to those injuries.

(3.) MR. Manohar, learned counsel for petitioner, contended that Mr. Chitnavis, who sustained injuries due to fall of the tree, was immediately rushed to Indira Gandhi Medical College and Hospital, Nagpur, where he was declared dead within a couple of hours after his admission in the hospital. It is submitted that Mr. Narayan Chitnavis was born on 10th january, 1946 and was enrolled as an Advocate by the Bar Council of maharashtra and Goa in the year 1969. The State of Maharashtra was pleased to appoint Mr. Chitnavis as Asstt. District Govt. Pleader in District Court for two terms and since the year 1996, he was also working as a Special counsel for the State of Maharashtra in District Court, and was assigned various important cases by Law and Judiciary Department, which he conducted till the time of his death. It is submitted that late Mr. Narayan chitnavis had successfully conducted criminal cases and he was awarded a Certificate by Police Department for his excellence in conducting criminal cases under the provisions of Preventation of Corruption Act.
