MUNJABA SUKHDEO KHETRE Vs. DEVGIRI SHIKSHAN PRAARAK MANDAL

JUDGEMENT

(1.) THESE are the two petitions filed against the respondents, namely, Deogiri shikshan Prasarak Mandal, Parbhani, through its Secretary Dr. Govind Pundlik gaikwad (respondent no. 1) and the Principal Shri Shankar Jagannath Gote, Deogiri college, Parbhani (respondent no. 2 ). Both the petitioners in these contempt petitions are working as Peons in the Deogiri College, Parbhani, which is run by the respondent no. 1 educational institution and headed by the Principal, Deogiri College (respondent no. 2 ). The petitioners are working in that capacity from December, 1990. In course of time, they were confirmed.

(2.) IN June, 1992, when the college reopened, as a result of some incident, the then in-charge Principal Shri Arun Jadhav did not pay the salaries for the months of june, July and August, 1992. They were also not allowed to sign the Muster Roll and their services were orally terminated.

(3.) BOTH of them preferred appeals u/s 42-D of the Maharashtra Universities act, challenging the oral orders of termination of their services.
