JUDGEMENT

(1.) The petitioner challenges in this writ petition the approval given by the Vice Chancellor of the Nagpur University to the appointment of the respondent 6 to the post of Lecturer in Commerce in a clear vacancy in the respondent 4 Mahavidyalaya of the respondent 3 Society.

(2.) The petitioner, who is M. Com., in Second Division of the Nagpur University, had joined as a Lecturer on 1-8-1974 in the faculty of Commerce in the Senior College named Smt. Radhabai Sarda College of Arts and Commerce at Anjangaon Surji, district Amravati. He served as a Lecturer in the Senior College in the above institution up to 1-10-1976, when he was determined fully surplus in view of the new pattern of education of 10 + 2 + 3. He, thereafter worked in the Junior College of the aforesaid institution up to 1-8-1977 where after he left the said college.

(3.) The petitioner was then appointed with effect from 14-8-1977 as a Lecturer in the faculty of Commerce in the Junior College attached to the respondent 4 Mahavidyalaya run by the respondent 3 society. It is the contention of the petitioner that during the period of service in the Junior College, he also took classes in Senior College of the respondent 3 Mahavidyalaya. The media of instructions in the Senior College of the respondent 4 Mahavidyalaya are English, Marathi and Hindi.
