JUDGEMENT

(1.) IT is apparent that after the previous order was passed the Original Petitioner No. wife had gone to the house of husband and one more child was born. This has given rise to fresh cause of action. Shri Siddiqui relied upon Bhupinder SinKh v. Daljit Kaur.1 Those observations are made in a different context. The husband was resisting execution on the ground that after the order was passed, the wife came to him for residence and hence the order cannot be executed. In the instance case after the order was passed in favour of wife, she went to her husband and both stayed together and she gave birth to one more child. Thereafter she again filed a fresh petition for maintenance for herself and for two children Previously also Rs. 200 P.M. were awarded to her and now also same amount is awarded to her and Rs. 100 P.M. for two children together. Hence the observations of the Supreme Court do not apply. No injustice done. Rejected. Petition dismissed.
