JUDGEMENT

(1.) Heard, Mr. Shalgaonkar, learned counsel appearing for the Appellant and Mr. Shinde, learned counsel appearing for the Respondent No. 1.

(2.) This Court by order dtd. 3/2/2023 framed following substantial question of law in this Second Appeal :-

The Second Appeal takes exception to the order dated 24 th July, 2019 passed by the learned District Judge-8, Sangli in Civil Miscellaneous Application No. 229 of 2014 by which delay condonation application filed in appeal challenging the Judgment and Decree dtd. 5/9/2011 in Regular Civil Suit No. 70 of 2002 was dismissed. As a result of the same, the Appeal before District Judge was dismissed and therefore the Second Appeal.
