JUDGEMENT

(1.) By this Indian Adoption Petition, the Petitioner and Prospective Adoptive Parents have sought adoption of female minor Arushi Vijay Yadav ("the said female minor") born on or about 6/11/2016. The said female minor was found abandoned by the Powai Police Station, Mumbai and admitted to the Petitioner Institution on 26/4/2022 as per the order of the Child Welfare Committee, ("CWC") Mumbai City I dtd. 26/4/2022 under the provisions of Juvenile Justice (Care and Protection of Children) Act , 2015. The Safe Custody Order of the CWC is on record at page 27 to the Petition.

(2.) After making due inquiry under Sec. 38 of the Juvenile Justice (Care and Protection of Children) Amendment Act, 2021, the CWC declared the said female minor Arushi Vijay Yadav "legally free for adoption" on 19/10/2022. The Free for Adoption Certificate has been placed on record at Pages 24 - 25 to the Petition.

(3.) The Prospective Adoptive Parents are Indian Nationals residing at Pune aged about 39 and 40 years respectively. They have been married for the past 15 years (21/2/2008) with one biological daughter aged about 12 years (DoB:18/3/2011). The birth certificate, consent letter and health report have been placed on record at pages 31-34 to the Petition.
