(1.) The following question falls for my consideration:
(2.) Sec. 141 of the Negotiable Instruments Act, 1881 (hereinafter referred to as the "Act of 1881"), reads thus:
(3.) As could be seen, Sub Sec. (1) of Sec. 141 of the Act of 1881, provides that if a person committing an offence under Sec. 138 of the Act of 1881 is a company (firm) every person who, at the time the offence was committed, was in charge of, and was responsible to, the company for the conduct of the business of the company, as well as the company (firm), shall be deemed to be guilty of the offence and shall be liable to be proceeded against and punished accordingly.
