(2.) The 3rd Respondent, DY Patil Medical College, obviously does not think it is necessary to respond to notices issued by the Court or to remain present. This is not just regrettable but is a matter of concern that a college believes that no Court can compel it to attend or to act in a certain manner. If the College fails to remain present despite notice, it takes the consequences. Among these is that it will not be permitted to complain that it was not heard.

The three Petitioners challenge the retention of original certificates that they submitted when they took admission to the 3rd Respondent, the DY Patil Medical College (a deemed university), at Kolhapur. That College has also not issued the original post- graduation mark-sheets, passing certificates and degree certificates. There is no dispute that the State of Maharashtra, on 19/5/2018, disallowed private Colleges from demanding that students serve out a mandatory service bond on completion of their medical studies. In October 2018, the University Grants Commission ("UGC") issued a notification saying that Colleges that were recognized by it either as universities or deemed universities, could not retain original certificates submitted at the time of admission.
