MEHBOOB KASIM SHAIKH Vs. STATE OF MAHARASHTRA

JUDGEMENT

(1.) This is an application for pre-arrest bail in connection with C.R. No. 416 of 2023 registered at Dehu Road police station for the offences punishable under Sec. 376(2)(n), 420, 467, 468, 471 read with 34 of Indian penal Code, 1860 and Sec. 4, 6, 8, 9, 10 and 11 of the Prohibition of Child Marriage Act, 2006.

(2.) The applicant is brother of 'U', the co-accused, who was in relationship with the victim who was then 16 years of age.

(3.) The first informant who is a social activist learned about the alleged sexual exploitation of the victim and the surreptitious marriage of the victim with the co-accused, while she was a minor. It further transpired that victim had carried pregnancy out of the physical relations with the co-accused 'U' and the pregnancy was got terminated.
