JUDGEMENT

(1.) Heard Mr. Kakodkar, learned Counsel for the appellant and Mr. R.G. Ramani, learned Senior Counsel for respondent nos.1 & 2.

(2.) This appeal has been filed by the appellant/Insurance Company challenging the award made under Sec. 166 of the Motor Vehicle Act, 1988 (said Act).

(3.) There is no dispute in this case that no leave was obtained under Sec. 170 of the said Act by the appellant/Insurance Company before the Motor Accident Claims Tribunal.
