JUDGEMENT

(1.) Heard Mr. C. Padgaonkar, learned Counsel for the petitioners and Mr. D. Pangam, learned Advocate General appearing along with Mr. S. Parab, learned Additional Government Advocate for the respondents.

(2.) The grievance of the petitioners is that the respondents have commenced the construction of a road through the petitioners' property bearing Survey No.87/4 of Savoiverem, without obtaining any No Objection Certificate (NOC) from the petitioners for acquiring the said property in accord with law.

(3.) Considering the allegations made in this petition, notices were issued to the respondents with directions to file affidavit. Accordingly, Mrs. Sadhana Bandekar holding charge as Executive Engineer, Works Department XVIII (Roads), PWD, Ponda, Goa, has filed an affidavit before us.
