RAMCHANDRA TUKARAM DUBALE Vs. STATE OF MAHARASHTRA

JUDGEMENT

(1.) Heard learned counsel for the parties.

(2.) By this application, the applicant seeks his enlargement on bail in connection with C.R. No. 409 of 2020 registered with the Satara City Police Station, Satara, for the alleged offences punishable under Sections 302 and 160 of the Indian Penal Code.

The First Informant - Ramesh Shikare, Police Naik attached to Satara Taluka Police Station, has stated in the FIR that the incident took place on 4th June 2020, outside the said police station. He has stated that the applicant was called to the police station and was standing outside the police station when suddenly at 11:15 a.m. one person in a blue shirt (applicant) was seen running and a person wearing a yellow shirt i.e. deceased was chasing him. The said person wearing a yellow shirt was stated to be armed with a koyta. He has stated that the said person in yellow shirt started assaulting the person wearing a blue shirt (applicant) with the koyta, pursuant to which he and others went and stopped the said assault. He has stated that when the koyta fell down from the hand of the person wearing the yellow shirt, the person in the blue shirt (applicant) picked up the koyta and assaulted the said person wearing the yellow shirt. He has further stated that the person wearing the blue shirt had also sustained grievous injury, pursuant to which he as well as the person in the yellow shirt were sent to the hospital. The person in the blue shirt is stated to be the applicant and the person in the yellow shirt is deceased - Suresh Kamble. With respect to the said incident dated 4th June 2020, the applicant has also lodged an FIR, which was registered vide C.R. No. 410 of 2020. The said FIR is on page 97 of the application. In the said FIR lodged by the applicant, which complaint was recorded in the hospital, the applicant has stated that 5 months prior to the incident, under the influence of alcohol, Sunny Kamble, son of the deceased had assaulted the applicant's wife, pursuant to which, the applicant and his wife had lodged a complaint , the applicant picked up the koyta and assaulted Suresh Kamble with the same koyta.
