We have heard this matter extensively and at the end of the hearing, when this Court expressed its opinion, orally about its mind to issue direction to the concerned Police Station Officer to register additional offences under relevant sections of the Indian Penal Code, learned counsel for the petitioners took a brief time out for consulting the petitioners with a view to salvage the situation in which the petitioners now find themselves.
(2.) Shri. Dhawas, learned counsel appearing for the petitioners, has returned to this Court after due consultation with these petitioners. It is his submission upon seeking further instructions in the matter that the petitioners have prayed for a leniency from this Court on the ground that they are already facing departmental action and that they be permitted to withdraw this petition unconditionally.
(3.) Learned Addl. Public Prosecutor has strongly opposed such prayer by the petitioners and he pleads for issuance for a direction to add more offences under the relevant sections of the Indian Penal Code considering the fact that prima facie, the actions of the petitioners have disclosed commission of all these offences and that these petitioners have acted in connivance with the plaintiff in Special Civil Suit Nos. 670 of 2003 and 672 of 2003, in which Special Darkhast No.09 of 2018 and 10 of 2018 were filed for execution of the decree.
