THESE two petitions are filed under Article 227 of the Constitution of India and Section 482 Criminal Procedure Code for quashing of complaints vide LAC No. 653/2010 and MECR No.8/2010 under Sections 63, 69 and 51 of the Copy Rights Act and Section 7, 16 and 17 of Cable Television Network (Regulation) Act, 1955. A private complaint came to be filed by respondent no.3 to these petitions complaining of the offences under the above mentioned provisions. On the private complaint, a police inquiry had been directed by the learned Metropolitan Magistrate. Thereafter, the offence has been registered by the police in the respective cases. It appears that during the course of investigation into the complaints the parties have arrived at amicable settlement. Respondent no.3 in both the petitions has filed affidavit disclosing the fact of the settlement and stated specifically that respondent no.3 does not desire to proceed with the complaint. The affidavits also state that the subject matter of the cases are purely private and personal in nature affecting only the business interests of the company and does not have any impact on the public at large.
(2.) ON perusal of the affidavit, I am satisfied that there is bonafide settlement arrived at between the parties. There will be no purpose served by continuing with the criminal proceedings. Hence, the petitions are allowed in terms of prayer clause (b).
