JUDGEMENT

(1.) HEARD Shri Tamba for the contemner and Shri Bhise for the employee of the institution.

(2.) THE learned Counsel for the contemnors, contended that the liability of payment as directed by the tribunal till the reinstatement of the employee comes to Rs. 1,10,647/ -. The cheque dated 6-2-2001 for the above referred amount has been handed over to the employee, Shri Sudan Divkar on 10-2-2001. The learned Counsel, therefore, submitted that the cognizance taken by this Court under the provisions of the Contempt of Courts Act may be dropped and notice may be discharged.

(3.) THE learned Counsel appearing for the employees, contended that there is a dispute between the amount due and payable by the management to the employee. The above referred amount of Rs. 1,10,647/- is not the full and final settlement. As far as these facts are concerned, it is difficult for this Court to go into the factual aspect in this regard. However, this issue is kept open.
