JUDGEMENT

(1.) THE questions of law raised in this reference read thus : asst. yrs. 1960-61, 1961-62 and 1962-63.

(2.) THE counsel are agreed that both the questions are covered by this Court's decision in the case of CWT vs. Bhogilal H. Patel reported in 1977 CTR (Bom) 740 : (1978) 112 ITR 910 (Bom ). In view thereof, both the questions are answered in the affirmative and in favour of the assessee. No order as to costs.
