SUDARSHAN Vs. STATE OF MAHARASHTRA

JUDGEMENT

(1.) The applicant apprehending arrest in connection with the offence punishable u/s 353,504,506 of Indian Penal Code registered vide Crime No. 33/2020 with Hatta police station, Taluka Basmathnagar, District Hingoli, preferred this application seeking anticipatory bail.

(2.) Heard learned counsel for applicant. Perused the Order passed by learned Additional Sessions Judge and copy of F.I.R.

(3.) In brief, it is the contention of learned counsel for applicant that applicant is having strong apprehension that he may be arrested and humiliated for no offence committed on his part. It is submitted that informant the Talathi of village Savangi (Bk.), lodged false complaint against him alleging therein that he has snatched and thrown the revenue book and gave threat to kill him. It is submitted that the land bearing G.No. 216 situated at village Savangi (Bk.) mutated in the name of Ganesh Bhagwanrao Katore though the applicant entitled to succeed said property by way of succession without any proclamation and notice. After getting knowledge as to execution of sale deed and recording of mutation entry in respect of said property, the applicant simply enquired from informant as to why he has not given prior notice/proclamation and invited objection before recording mutation entry in respect of said land. The query made to applicant was taken otherwise and informant lodged false complaint against applicant that he has snatched and thrown the revenue book and caused threat to kill him. It is submitted that applicant is a educated person. He has completed graduation. Now doing M.A. In the event of arrest of applicant, the applicant may be humiliated and harassed for no offence committed on his part.
