(1.) Mr.Brahme, learned counsel for the appellant and Mr.Sant, learned counsel for the respondents submit that the parties to appeal have amicably settled the matter. In terms of settlement, the respondents have agreed to vacate the suit premises by accepting sum of Rs.5,51,000/-. In terms of settlement reached between the parties, the parties have filed terms of compromise, which are duly verified and identified before the Registrar [Judicial]. The terms of compromise are collectively marked as 'X' for identification. The report of the Registrar [Judicial] submitted in respect of the verification and identification of the parties is marked as 'Y' for identification.
(2.) Learned counsel representing parties submit that they identify their respective clients who are signatories to consent terms filed on record. They further submit that beside their respective clients they have signed the consent terms and settlement between the parties is voluntary and in the interest of their respective clients.
(3.) The settlement reached between the parties appears to be voluntary. The terms of compromise are duly verified before the Registrar [Judicial]. On verification and identification of the parties, the Registrar [Judicial] has submitted report. The terms of compromise are also signed by the advocates representing the parties. I am therefore inclined to allow the parties to appeal to compromise the matter. Hence, the following order is passed :
