JUDGEMENT

(1.) The applicant is seeking bail in connection with Crime No.176/2020, registered with Police Station Harsul, Aurangabad, for the offence punishable under Section 20 (Bt of the Narcotic Drugs and Psychotropic Substances Act, 1985.

(2.) Heard both sides.

(3.) The learned Counsel for the applicant submits that though the applicant was caught raid handed as per the allegations made in the complaint, the involved quantity of the contraband article 'ganja' is lesser than the commercial quantity but greater than small quantity. The learned Counsel submits that in view of the same, the provisions of Section 37 of the Narcotic Drugs and Psychotropic Substances Act, 1985, are not applicable to the facts of the present case. He submits that there is no criminal history. The applicant is having a flied place of residence. The applicant is available for trial. He, therefore, submits that the applicant may be released on bail.
