(1.) Hearing was conducted through Video Conferencing and the learned Counsel agreed that the audio and visual quality was proper.
(2.) Heard learned Advocate Shri P. A. Kadu for the petitioner. He has pointed out documents filed at Annexure-I, page no. 14 of the compilation and letter issued by Block Development Officer dated 25-9-2013 at Annexure-II at page no. 17. Learned Advocate has submitted that the petitioner is owner of disputed plot. He had not made any encroachment on the Government or public land. The Collector and Additional Commissioner not considered the material documents and wrongly directed the petitioner to remove encroachment and, therefore, prayed to grant stay to the orders passed by the Collector, Amravati and Additional Commissioner, Amravati.
(3.) The earlier order passed by Additional Collector was challenged before this Court and the petition was withdrawn. Thereafter review petition was filed before the Additional Commissioner, Amravati Division, Amravati vide Review Petition No. 76/BVP 53(3-B)/Astagaon/ 2014-15 and same came to be dismissed on 20-11-2019. Looking to the submissions, issue notice to the respondents, returnable after four weeks.
