(1.) The suit seeks partition of the estate of late Ismail Mohammed Lakdawala. Plaintiff no.1 is the widow of the deceased, plaintiff nos.2 and 3 are the daughters of the deceased and defendant nos.1 to 5 are the sons of the said deceased and plaintiff no.1. The deceased is believed to have left behind several properties described in Exhibit-B to the plaint. The 29 properties listed in Exhibit-B are said to be correctly described.
(2.) At the hearing of the ad-interim application, which seeks appointment of Court Receiver, High Court, Bombay as Receiver of the properties listed in Exhibit-E to the plaint as also an injunction restraining the defendants from parting with possession, creating any third party rights or encumbrances in the suit properties, the learned counsel for the defendants, on instructions, states that the defendants are willing to submit to the appointment of the Court Receiver, High Court, Bombay in respect of all the properties described in Exhibit-E to the plaint.
(3.) In addition, it is submitted that particulars of all investments in the shares and other securities, bank accounts, fixed deposits, mutual funds etc. will be disclosed in an affidavit to be filed within a period of four weeks from today. It is further stated that particulars of all jewellery will also be disclosed along with the particulars. Valuation reports, if any, also will be offered within a period of twelve weeks from today.
