(1.) This is an application preferred by the applicant for anticipatory bail.
(2.) Facts giving rise to this application are that the applicant is the Assistant Regional Transport Officer. The informant is the Deputy Regional Transport Officer, Aurangabad. A secret information was received that two stolen goods trucks bearing fake registration numbers were parked at Jabinda Lawns, Beed Bye Pass, Aurangabad bearing nos.MH-20-AU-0506 and MH-40- BL-5334. These two trucks were siezed by the police. On inspection, it was noticed that there was variance between the papers of the said truck and chasis number on the vehicle. There were no papers of truck no.MH-40-BL- 5334. On interrogation of three persons present at the spot, it was revealed that the truck no.MH-20-EL-3229 was in possession of one Sayyed Sattar. The NOC, insurance and other papers were fake. Therefore, communication was made with the RTO Office. On receipt of the copies from the RTO Office, it was revealed that one Pradip Lalsingh resident of Gurgaon is the owner of truck no. MH-20-EL-3239 and the original number of the said truck was MH- 03-D-1413. It was revealed that application for transfer of vehicle was submitted at RTO Office, Aurangabad. On inspection of papers, it was found that the said Pradip Lalsingh had mentioned his address as Magrabi Compound, Aurangabad. The police visited the said place but the address was found to be incorrect and the said Pradip Lalsingh was not staying there. It was also found that the Aadhar card was fake and other papers were also fake. TATA motors, on making communications with it, informed that they did not have any record relating to chasis number of truck no. MH-20-AU-0506. On scanning QR code of the vehicle no. MN-03-D-1413 if turned out to be of Ashok Leyland but in other papers the said truck was recorded to be of Tata company. On making inquiries with the HDFC, Ergo Insurance Company it was revealed that the insurance was fake. The inquiry papers submitted for re-registration of the vehicle were also found to be fake and forged.
(3.) It was further revealed that fake and forged documents were submitted for on-line NOC and re-registration of vehicle nos. MH-20-EL-3236, MH-20-EL-3237, MH-20-EL-3238, MH-20-EL-3239, MH-20-EL-3240. It was further revealed that forged documents were produced for re-registration of the vehicles bearing nos. MN-03-D-1275, MN-03-D-1292, MN-03-D-1283, MN-03-D-1281 in the RTO Office, Aurangabad and certain directions were issued by the Transport Commissioner, Mumbai in respect of motor vehicles registered in states other than Maharashtra.
