JUDGEMENT

(1.) I. M. Quddusi, J. This writ petition has been filed for getting scrutiny of the marks awarded to the petitioners in English IInd paper of the High School Examinations, 1998 conducted by U. P. Board of High School & Intermediate Education. The petitioners are girls stu dents who are 12 in number. The petitioners had appeared in the High School Examination, as regular students of Government Girls Inter College, Uttar Kashi. Along with 67 students, the petitioners were awarded Zero marks in English IInd paper. On this, the guardians of the examinees agitated and approached the authorities of the Education Depart ment. They had sent a representation to get the cases of the petitioners scrutinised afresh. In Dainik Jagaran Newspaper, a news was published on 4-8-1998 that a big racket has been detected in the Meerut Region regarding manipulation of marks in the High School examinations, 1998 and as the petitioners case also came with in that region, this writ petition has been filed under the apprehension that the petitioners may also be the victim of the manipulation of marks.

(2.) THE answer books of English IInd paper of the petitioners were summoned by this Court which were produced before this Court. A counter-affidavit has also been filed in which it has been stated that a complaint was sent to the D. I. O. S. , Ultar Kashi through the Principal, G. G. I. C. , Uttar Kashi and the same was received in the regional office of Madhyamik Shiksha Parishad, Meerut on which basis, the answer books of English IInd paper were again examined and since there was no fault in awarding the marks by the ex aminer, the same was communicated to the D. I. O. S. vide order dated 1-8-1998 in which, it was specifically stated that all the replies of the question mentioned in those 67 answer books were valuated and none of the answer of the aforesaid answer books were found unvaluated. It has also been averred in the counter-affidavit that there is no provision to revaluate the answers and as such, the marks awarded to the petitioners in English IInd paper were correct and the same cannot be revaluated.

(3.) IN the result, the writ petition fails and is here by dismissed. No order as to costs.
