JUDGEMENT

(1.) O. P. Garg, J. Heard Smt. Shiksha Singh learned counsel for the petitioner.

(2.) THE petitioner is duly elected Pradhan of the Gaon Panchayat concerned. A motion of no confidence has been brought against him. THE learned counsel for the petitioner pointed out that the notice has been issued by Respondent No. 2 on 17-4-1999 and the date for consideration of no confidence has been fixed on 1-5-1999. It was pointed out that under the provision of Section 14 of the U. P. Panchayat Raj Act and Rule 33-B of the Rules framed therein 15 days clear notice is required to be served before the meeting for considera tion of no confidence motion, may be con vened. THE meeting which is being held on 1-5-99 in pursuance of the notice dated 17-4-1999 is not beyond the period of 15 days.
