JUDGEMENT

(1.) This is an appeal against the judgment and order dated 25-4-1997 passed by Sri B. G. Saxena, the then Ist Additional Sessions Judge, Azamgarh in S.T.N. 87 of 1994, under S. 304, IPC, whereby he convicted the accused-appellant Manoj Kumar Rai of the offence Under S. 304, Part-I, IPC and sentenced him to undergo R.I. for a period of 10 years.

(2.) I have heard the learned Amicus Curiae appearing for the accused-appellant and the learned A.G.A.
