JUDGEMENT

(1.) This is a plaintiffs appeal against the judgment and- decree dated 19-8-1969 passed by the Civil Judge Bareilly in Civil Appeal No. 141 of 1968.

(2.) Respondent Gopal Krishna Misra has filed cross-objection.

(3.) The plaintiff-appellant had filed suit for specific performance of a contract entered into by Gopal Krishna Misra, respondent No. 3 on 29-9-1965 (Ex. I). The respondent agreed to sell the agricultural land for Rs. 1,300. A sum of Rs. 100 was paid as earnest money. The respondent No. 3 executed an agreement.
