JUDGEMENT

(1.) NEPAL Singh revisionist has filed this revision application against his conviction under Section 420 IPC and the sentence of 12 months' R. I.

(2.) RAJ Singh complainant was Kurk Amin in Block Hapur, district Ghazia- bad and his duties were to realise arrears. Nepal Singh had taken loan from the Co-operative Society and Rs. 2051.95 were to be realised from him. On 15-12-1970 at about 3 p. m. he went at the house of RAJ Singh with 20 bundles of currency notes. Each bundle was said to contain 100 currency notes of Re. 1/-. The revisionist had placed one genuine currency note at the top and at the bottom of each bundle in order to give an impression that all the notes were genuine. In between the genuine currency notes were blank papers. When RAJ Singh wrote out the receipt and tore it from the receipt book the revisionist snatched away the receipt and after throwing the bundles of currency notes before him made good his escape. Its report was lodged at 6.05 p. m. on the same day.'

(3.) THE revision application is dismissed subject to the modification that the revisionist's conviction under Section 420 IPC is maintained but the sentence is reduced to three months' R. I. and to a fine of 500/- and in default of its payment to three months' further R. I. THE revisionist is on bail and will surrender forthwith or be taken into custody to serve out the sentence. Revision dismissed.
