STATE OF U.P. Vs. SHAKUNTALA DEVI

JUDGEMENT

(1.) State of U.P., through Secretary, Government of U.P., Irrigation Department, Lucknow and 5 other State functionaries have preferred this special appeal challenging order dated 28.04.2006 rendered in Writ Petition No.7038 (SS) of 2001 titled 'Shakuntala Devi vs. State of U.P. and others'. Vide the impugned order, the writ petition has been disposed of in terms of order dated 25.07.2005 rendered in Writ Petition No.51469 (SS) of 2005 titled 'Vijay Kumar Yadav Vs. State of U.P. and others'.

(2.) Learned counsel for the respondent/writ petitioner has not appeared.

(3.) Learned counsel for the appellants/State has pointed out that it is the admitted case of respondent/writ petitioner that the respondent/writ petitioner is widow of Shri Madan Yadav who died on 01.12.1999. Deceased employee was appointed as part-time Tube-well Operator in the year 1998 and subsequently became entitled to payment of salary admissible to regular Tube-well Operator vide judgement rendered by the Writ Court dated 18.05.1994.
