JUDGEMENT

(1.) Petitioner has made following prayers in the petition :

(2.) Heard Sri Jalaj Kumar Gupta, learned counsel for petitioner, learned Additional Government Advocate for State of U.P. and Sri S.B.Pandey, Assistant Solicitor General of India and Sri S.M.Royakwar appearing for Union of India.

The facts in brief according to the prosecution are that an FIR was lodged at Case Crime No.0104 of 2019, under Sections 3/5/8, Cow Slaughter Act, Police Station Mitauli, District Kheri, against unknown persons by Sub Inspector Anil Kumar Rajpoot stating therein that on 21.03.2019 on the occasion of Holi, he along with other police personnel were deployed in halka no.4 for maintaining peace, then some persons of village Andhraula informed that after slaughtering the cow in sugarcane field her meat was being taken by unknown persons for sale. On such information, the first informant along with other police personnel reached at alleged spot and allegedly recovered 20-25 kg. pieces of meat and also recovered scale, weight and knife kept in a bag from the field of Guddu Sai; he took a piece of meat as sample for veterinary doctor and rest meat was got buried. The persons carrying meat were fled away from the spot and persons of the village namely Umesh, Amit Singh, Dileep Singh and Vijay Prakash told that the offence may be committed by Maiku Bhurji and Guddu Sai.
