(1.) Heard Ms. Shradha Misra, learned counsel for the petitioner. Notices for the opposite parties have been accepted by the office of learned CSC.
(2.) The case set forth by the learned counsel for the petitioner is that the petitioner, who was serving on the post of Assistant Teacher, retired on 30.6.1997. After retirement, the petitioner was paid his pension and other retiral dues.
(3.) Time to time the pension of the petitioner was revised strictly as per the Government Orders and the petitioner has been paid the benefit of aforesaid revision by the Department itself. All of sudden, in the month of April, 2019, pension of the petitioner was reduced without affording an opportunity of hearing to the petitioner and feeling aggrieved out of the said inaction, the petitioner preferred a representation dated 28.6.2019 (Annexure No.6 to the writ petition). Since some amount was deducted from the pension of the petitioner, therefore, the petitioner raised such grievance in his representation indicating therein that this action has been taken by the authorities without intimating the petitioner, who is presently aged about 83 years and his wife, who is aged about 80 years, both have been suffering from various ailments. The aforesaid representation of the petitioner was rejected by the Senior Treasury Officer, Unnao on 11.7.2019, the impugned order, wherein it has been indicated that a sum of Rs.49,380/- has already been deducted from the pension of the petitioner and the remaining amount of Rs.1,97,520/- is also recoverable as it is excess amount, therefore as per the impugned order, the petitioner has been directed to deposit the remaining amount i.e. Rs.1,97,520 in the Government Treasury so that his pension could be regularized.
