JUDGEMENT

(1.) Heard learned counsel for the petitioner, learned Standing Counsel appearing for respondent nos. 1 to 3, Sri Manish Mishra, learned counsel appearing for respondent no.4 and Sri Rahul Srivastava, learned counsel appearing for respondent no.5.

(2.) By means of the present petition, the petitioner has challenged the promotion order of respondent no.5 dated 25.07.2013, a copy of which is Annexure-8 to the petition, by which respondent no.5 has been posted as Headmistress at Primary School Mirzapur, Chinhat. A further prayer is for a mandamus commanding the respondents to promote the petitioner on the post of Headmistress with effect from the date of promotion of her next junior with all attendant benefits and for posting the petitioner as Headmistress, Primary School, Mirzapur.

(3.) It is admitted by all the contesting parties that the petitioner is senior to respondent no.5.
