JUDGEMENT

(1.) Heard Sri Adeel Ahmad Khan, learned counsel for the petitioner and Sri Vivek Srivastava, learned Standing Counsel.

(2.) By means of the present writ petition, the petitioner has challenged the order passed by respondent no. 4- District Supply Officer, District Maharjganj, whereby he has restored the license of fair price shop of respondent no. 7 and has cancelled the license of the petitioner.

(3.) The brief facts of the case are that respondent no. 7 was a fair price shop allottee of Gram Panchyat Pipra Narayan, Block Mithaura, Tehsil- Sadar, District Maharajganj. It appears that on some complaints against respondent no. 7, the proceeding for cancellation of license of respondent no. 7 was undertaken by respondent no. 3 Sub Divisional Officer, Sardar District Maharajganj and after conducting the enquiry the license of the respondent no. 7 has been cancelled by respondent no. 4 by order dated 22.11.2012.
